Crime Victims’ Rights

Fear of their traffickers can keep survivors from seeking justice; advocating for the sentencing of their perpetrators and pursuing restitution. Our attorneys represent clients during the criminal prosecution of traffickers to ensure the victims rights are protected according to “Marsy’s Law”, California’s 2008 Victims’ Bill of Rights Act .

Justice At Last specializes in crime victims’ rights. In California, under thein the California Constitution, victims of crime have a right to meaningfully access the legal system to hold traffickers accountable.  They also have the right to restitution.  Our Crime Victims’ Rights Attorneys represent survivors to ensure their rights are protected and enforced.

Right To Be Heard Survivors have the right to be heard at any criminal proceeding against the trafficker, including a hearing involving a post–arrest release decision, plea, sentencing, post–conviction release decision, restitution, or any proceeding in which a right of a survivor is at issue.

Right to Protection Survivors have the right to be reasonably protected from the trafficker and persons acting on the trafficker's behalf. And, to have safety considerations factored when fixing the trafficker's bail amount and release conditions.

Right to Fairness and Respect Survivors have the right to be treated with fairness and respect for their privacy and dignity, and to be free from intimidation, harassment, and abuse, throughout the criminal or juvenile justice process against the trafficker.

Marsy’s Law

Marsy’s Law, a measure to provide all victims with due process and rights, was approved by California voters in 2008. Marsy’s Law gives crime victims constitutional rights similar to those accused and convicted of crimes. For more information, click here.
